§ 34.017 GENERAL.
   (A)   Dangerous business. No person, firm, partnership, association, company or corporation shall carry on a business in the city, or maintain any building, structure or premises in a manner as to endanger the building, structure or premises from fire or explosion, or to endanger life or other property.
   (B)   Liability for damages.
      (1)   This subchapter shall not be construed to hold the city responsible for any damage to persons or property by reason of the inspection or investigation authorized herein or failure to inspect or investigate, or in the issuance of permits as authorized by other ordinances, or by reason of approval or disapproval of any material, equipment, device or installation.
      (2)   The Fire Chief, the Fire Marshal, his or her duly authorized representative or any employee charged with the enforcement of this subchapter, while acting for the city, shall not thereby render himself or herself liable personally, and he or she is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or permitted in the lawful discharge of his or her official duties. Any suit, instituted against any officer or employee because of an act performed by him or her in the lawful discharge of his or her duties and under the provisions of this subchapter shall be defended by the Legal Department of the city until the final termination of the proceedings. In no case shall the Fire Chief, the Fire Marshal, his or her duly appointed assistants or any employee charged with the enforcement of this subchapter be liable for costs in any action, suit or proceeding that may be instituted in pursuance of the provisions of this subchapter; and any officer of the Fire Department, acting in good faith and without malice, shall be free from liability for acts performed under any of its provisions or by reason of any act or omission in the performance of his or her official duties in connection therewith.
