§ 34.002 WORK WEEK.
   Except as otherwise provided for in a collective bargaining agreement between the city and the union(s) representing fire personnel, the leave of absence of uniformed members of the Fire Department shall be for each member, at least one day of 24 consecutive hours off duty in every 48 hours, the leave days to be sufficient in number so as to provide an average 56 hour work week and a furlough of 20 days in each year, of which at least ten days shall be consecutive. Provided, however, that this shall not prohibit the Fire Chief from suspending any leave of absence or furlough temporarily as a matter of discipline for misconduct or dereliction of any firefighter. Provided further, that this subchapter shall not apply in case of emergency and the existence of the emergency shall be within the sole determination of the Mayor in consultation with.
