No licensee under the provisions of this chapter shall for himself or herself, or through his or her agents or employees, do any of the following:
A. General:
1. Make any sale of alcoholic liquor in violation of the authority granted the licensee pursuant to this chapter or in violation of the laws of the state.
2. Sell or possess for sale any package containing alcoholic liquor unless the same shall have affixed thereto all canceled revenue stamps which may be required by law.
B. Minors And Others:
1. Sell alcoholic liquor to any person who is under the age of twenty one (21) years.
a. Whenever the holder of a liquor license issued by the village, or any of his or her agents or employees, believes, has reason to believe, or reasonably should have had reason to believe that a sale or delivery of any alcoholic liquor is prohibited because of the age of the prospective recipient, he or she shall, before making such sale or delivery, demand from such prospective recipient presentation of an identification document, such as a driver's license, containing proof of age, and issued by a public officer in the performance of his or her official duties.
2. Sell alcohol liquor to any intoxicated person, habitual drunkard, or insane, feeble minded or distracted person.
3. Employ or permit the employment of any minor in his place of business except in connection with activities not related to the sale or delivery of alcoholic liquors.
4. Permit any person under the age of twenty one (21) years to sell, possess, or give away any alcoholic liquor on the premises for which such license is issued.
5. Permit any person under the age of twenty one (21) years to remain on the premises of any licensee; provided, the prohibition of this subsection shall not apply to:
a. Any person eighteen (18) years of age or older, when such person is on the premises pursuant to employment; or
b. Any person accompanied by his or her parent, legal guardian or spouse; or
c. Premises where food is sold, except in any area segregated and designated principally for the sale or consumption of alcoholic liquor; or
d. Bowling alleys, except in any area segregated and designated principally for the sale or consumption of alcoholic liquor.
C. Premises And Public Areas:
1. Harbor or permit any intoxicated persons to loiter on the premises described in the license, or permit any conduct which tends to disturb the peace or quiet of the neighborhood or the premises.
2. Serve any alcoholic beverage to any person for consumption on public streets or to any persons in motor vehicles on such streets.
3. Permit any person to consume any alcoholic liquor on the premises described in the license, unless such alcoholic liquor has been purchased on the premises.
4. Keep open for business or admit any person other than an employee who is then performing services during the hours within which the sale of such liquor is prohibited; or to permit or allow any person, other than an employee then performing services, to remain in or about the licensed premises either before or after the hours designated within which the sale and consumption of alcoholic liquors is prohibited on the licensed premises.
a. Provided, however, that grocery stores, convenience stores which operate on a twenty four (24) hour basis, restaurants, clubs, hotels, and motels may keep their places of business open subject only to the provisions that no sale at retail of alcoholic liquors or the consumption by patrons or customers or by the public of alcoholic liquors shall be permitted or allowed on said licensed premises during the hours prohibited; and
b. Further provided that employees may remain in or about the licensed premises either one hour before or after the hours designated within which the sale and consumption of alcoholic liquor is prohibited on the licensed premises for the sole purpose of conducting business related activities such as cleaning and inventory, expressly subject to the provision that no sale at retail of alcoholic liquors or the consumption by any persons of alcoholic liquor shall be permitted or allowed on said licensed premises during the hours prohibited.
5. Sell alcoholic liquor at any time other than during the service hours established in this article.
6. Permit any window display of liquor or other decoration of such a nature as will obstruct the view into the interior from the exterior.
7. Serve or permit any person to consume any alcoholic liquor in any curtained enclosure, or any rear or side room, or in any place on the premises not accessible to view from the exterior.
D. Other Offenses:
1. Sell any items of intimate apparel, including lingerie, undergarments, sleepwear or swimsuits;
2. Permit any card playing, game of chance, or gambling on the premises, except as otherwise allowed by the Illinois video gaming act, 230 Illinois Compiled Statutes 40/5-1-1 et seq., as now in effect or as hereafter amended.
E. Violation: Any person who violates the provisions of this section shall be guilty of a class A misdemeanor. (Ord. 16-08, 1-21-2016)
