Every person engaged in the retail sale of alcoholic liquor in the village shall pay an annual license fee. Such licenses shall be divided into the following classes:
A. Class A-1 License - Taverns/Carryout Sales:
1. Licenses for the sale at retail of alcoholic liquors, over the counter, for consumption on the premises as well as retail sales of such alcoholic liquors in the original package for consumption off the premises.
2. The annual fee for a class A-1 license shall be established from time to time by the board of trustees.
3. Establishments or premises holding a class A-1 liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed at the following times each week:
1:00 A.M. through 10:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday |
1:00 A.M. through 6:00 A.M. on Tuesday through Saturday |
4. Entertainment shall be allowed in the establishment and on the premises holding a class A-1 license for no additional fee, but acceptability of all entertainment shall be subject to review by the local liquor control commission.
5. Outdoor seating may be allowed in accordance with the provisions of Article XIII, Chapter 4 of this code.
B. Class A-2 License - Taverns/No Carryout Sales:
1. Licenses for the sale at retail of alcoholic liquors, over the counter for consumption on the premises.
2. The annual fee for a class A-2 license shall be established from time to time by the board of trustees.
3. Establishments or premises holding a class A-2 liquor license shall close each night at one o'clock (1:00) A.M., and shall be closed as follows:
1:00 A.M. through 6:00 A.M. Sunday through Saturday of each week |
4. Entertainment shall be allowed in the establishment and on the premises holding a class A-2 license for no additional fee, but acceptability of all entertainment shall be subject to review by the local liquor control commission.
5. Outdoor seating may be allowed in accordance with the provisions of Article XIII, Chapter 4 of this code.
C. Class B-1 License - Package Sales:
1. Licenses for the sale at retail of alcoholic liquors on the premises, solely in the original package and not for consumption on the premises.
2. The annual fee for a class B-1 license shall be established from time to time by the board of trustees.
3. Establishments or premises holding a class B-1 liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed at the following times each week:
1:00 A.M. through 8:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday through Saturday |
4. No entertainment shall be permitted in an establishment or on premises holding a class B-1 license.
D. Class B-2 License - Package Sales In Food/Convenience Stores:
1. Licenses for the sale at retail of beer and wine only for consumption off the premises only.
2. The annual fee for a class B-2 license shall be established from time to time by the board of trustees.
3. There shall be no sales of alcoholic liquors in any establishment or premises holding a B-2 liquor license after one o'clock (1:00) A.M. each night, except that on Sunday night they shall not sell alcoholic liquors after twelve o'clock (12:00) midnight, and shall be prohibited from the sale of alcoholic liquors between the following times each week:
1:00 A.M. through 10:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday through Saturday |
4. No entertainment shall be allowed in an establishment or on premises holding a class B-2 license.
E. Class C-1 License - Restaurants:
1. Licenses for the sale at retail of alcoholic liquors in restaurants for consumption on the premises, as well as retail sales of beer and wine only in restaurants in the original package for consumption off the premises.
2. The annual fee for a class C-1 license shall be established from time to time by the board of trustees.
3. Establishments or premises holding a class C-1 liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed at the following times each week:
1:00 A.M. through 10:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday |
1:00 A.M. through 6:00 A.M. on Tuesday through Saturday |
4. Entertainment shall be allowed in the establishment and on the premises holding a class C-1 license for no additional fee, but acceptability of all entertainment shall be subject to review by the Local Liquor Control Commission.
5. Outdoor seating may be allowed in accordance with the provisions of Article XIII, Chapter 4 of this code.
F. Class C-2 License - Restaurants:
1. Licenses for the sale at retail of alcoholic liquors in restaurants for consumption on the premises, provided, said alcoholic liquor shall be served only in conjunction with the service of food to patrons.
2. The annual fee for a class C-2 license shall be established from time to time by the Board of Trustees.
3. Establishments or premises holding a class C-2 liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed at the following times each week:
1:00 A.M. through 6:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday |
1:00 A.M. through 6:00 A.M. on Tuesday through Saturday |
4. Entertainment shall be allowed in the establishment and on the premises holding a class C-2 license for no additional fee, but acceptability of all entertainment shall be subject to review by the Local Liquor Control Commission.
5. Outdoor seating may be allowed in accordance with the provisions of Article XIII, Chapter 4 of this code.
G. Reserved.
H. Class C-4 License - Restaurants/No Carryout Sales:
1. Licenses for the sale at retail of alcoholic liquors in restaurants for consumption on the premises only, whether or not in conjunction with the service of food.
2. The annual fee for a class C-4 license shall be established at one thousand two hundred fifty dollars ($1,250.00), and may be adjusted from time to time by the board of trustees.
3. Establishments or premises holding a class C-4 liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed at the following times each week:
1:00 A.M. through 10:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday |
1:00 A.M. through 6:00 A.M. on Tuesday through Saturday |
4. Entertainment shall be allowed in the establishment and on the premises holding a class C-4 license for no additional fee, but acceptability of all entertainment shall be subject to review by the Local Liquor Control Commission.
5. Outdoor seating may be allowed in accordance with the provisions of Article XIII, Chapter 4 of this code.
I. Class D License - Hotels/Motels:
1. Licenses for the sale of alcoholic liquors in hotels and motels operating a dining room as a service for consumption on the premises only.
2. The annual fee for a class D license shall be established from time to time by the board of trustees.
3. Establishments or premises holding a class D liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed at the following times each week:
1:00 A.M. through 10:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday |
1:00 A.M. through 6:00 A.M. on Tuesday through Saturday |
4. Entertainment shall be allowed in the establishment and on the premises holding a class D license for no additional fee, but acceptability of all entertainment shall be subject to review by the Local Liquor Control Commission.
5. Outdoor seating may be allowed in accordance with the provisions of Article XIII, Chapter 4 of this code.
J. Class E License - Banquets:
1. Licenses for the sale at retail of alcoholic liquors in a banquet facility on the premises, in conjunction with hors d'oeuvres and/or meals on the premises.
2. The annual fee for a class E license shall be established from time to time by the board of trustees.
3. Establishments or premises holding a class E liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed at the following times each week:
1:00 A.M. through 10:00 A.M. on Sunday |
12:01 A.M. through 6:00 A.M. on Monday |
1:00 A.M. through 6:00 A.M. on Tuesday through Saturday |
4. Entertainment shall be allowed in the establishment and on the premises holding a class E license for no additional fee, but acceptability of all entertainment shall be subject to review by the Local Liquor Control Commission.
K. Class F License - Incorporated Clubs:
1. Licenses granted to a club for the sale at retail of alcoholic liquors, as well as other retail sales of such alcoholic liquors in the original package to members of the club.
2. The annual fee for a class F license shall be established from time to time by the board of trustees.
3. Establishments or premises holding a class F liquor license shall close each night at one o'clock (1:00) A.M., except that on Sunday night they shall close at twelve o'clock (12:00) midnight, and shall be closed as follows:
1:00 A.M. through 6:00 A.M. on Sunday |
12:01 A.M. on Sunday through 6:00 A.M. on Monday |
1:00 A.M. through 6:00 A.M. Tuesday through Saturday |
4. Entertainment shall be allowed in the establishment and on premises holding a class F license for no additional annual fee, but acceptability of all entertainment shall be subject to review by the Local Liquor Control Commission.
L. Class G License - Special Events:
1. A license for sale of alcoholic beverages at a special event may be obtained for a license fee of fifty dollars ($50.00).
2. Said license shall be designated a special event alcoholic liquor license, and shall be utilized by churches, schools, corporations, associations, not for profit organizations, and other entities separately or in conjunction with a village sponsored event.
3. The applicant for such license shall complete a proper application form bearing the criteria for issuance, upon terms set forth by the local liquor control commission. The applicant for such a license shall complete and file the application with the village clerk not less than thirty (30) days prior to date of issuance of the license.
4. The application shall specify the nature and duration of the special event, , and the license when issued shall specify the date(s) when, the place where, and any conditions, including conditions regarding entertainment, if applicable, under which such special event shall be conducted. The holder of a Class G special events license shall be allowed to sell and serve alcoholic beverages during the scheduled hours of said event as detailed in the application for said license, but in any case said holder shall not commence the sale and service of alcoholic beverages on each scheduled day of said event earlier than ten o'clock (10:00) A.M., and shall cease the sale and service of alcoholic beverages not later than one o'clock (1:00) A.M. the next following day.
5. Said license shall allow its holder to sell alcoholic beverages between the hours of one minute past twelve o'clock (12:01) P.M. through twelve o'clock (12:00) midnight on any day for which said license has been issued, unless otherwise restricted pursuant to subsection L4 of this section.
6. Entertainment may be allowed in the establishment and/or on premises holding a class G license for no additional fee, but acceptability of all entertainment shall be subject to review and approval and imposition of conditions before issuance of any license.
7. Any such application shall be subject to review and approval, and imposition of conditions, in accordance with section 3-1-3 of this article, by either the liquor control commissioner, or the local liquor control commission, as the case may be.
8. A person or entity shall be entitled to no more than two (2) special event licenses in any one calendar year.
M. Class H License - Beauty Salon Or Spa:
1. Licenses for the retail sale and delivery of wine beverages by the drink to customers of beauty shops, spas, salons and personal cosmetic establishments, exclusively as an adjunct to a principal beauty shop, spa, salon or personal cosmetic business, strictly incidental to the customer's receipt of personal beauty and cosmetic services, and for consumption on the personal cosmetic establishment premises only. The retail sale of wine beverages by the drink pursuant to a class H license is expressly subject to the following further conditions:
a. The retail sale of wine beverages to a customer of the personal cosmetic establishment is limited to one drink per hour, and no customer shall be served more than two (2) wine beverages during the permitted hours of retail sale of wine beverages during any single calendar day.
b. Customers and patrons shall not be served wine beverages unless receiving contemporaneous spa/salon services from the license holder.
c. No live entertainment of any nature is permitted on the licensed premises.
d. No window or any other signage visible from the outside of the business shall be permitted on the specified premises or surrounding property that indicates that wine beverages are available for retail sale at the specified premises, provided, however, that the business identification signage may contain the word "bar", and provided further that the word "bar" is only used as part of the business name.
e. No person holding a class H license issued pursuant to this chapter shall sell, offer, deliver, or permit to be sold, offered for sale, given away or delivered, any alcoholic liquor except between the hours of eleven o'clock (11:00) A.M. and nine o'clock (9:00) P.M. Monday through Saturday.
2. The annual fee for a class H license shall be established at five hundred dollars ($500.00), and may be adjusted from time to time by the board of trustees.
N. Class I License - Hampshire Township Park District:
1. A license for the sale at retail of beer and wine only, as follows:
a. To patrons of special adult events or classes conducted or sponsored by the park district, and strictly incidental to the patron's participation in such event or class, wine beverages only, by the drink, for consumption on the premises where the event or class is conducted only; and
b. For special events sponsored or conducted by the park district, on park district property, beer and wine beverages, by the drink, for consumption on the grounds only.
2. Events and classes allowed under this classification shall be limited to not more than a total of twenty five (25) per calendar year. For purposes of this subsection N, an event may be more than one day, as approved by the local liquor control commission, and each day of any class shall be considered a separate class.
3. The fee for a class I liquor license shall be five hundred dollars ($500.00) per year.
4. The park district shall in its annual application for liquor license identify the events and/or classes at which alcoholic liquors shall be available, and any conditions under which such class or event is to take place, including, but not limited to, date(s) and times; provided, if not then known, whenever an event or class is thereafter to be sponsored or conducted by the park district, the park district shall not later than twenty one (21) days prior to the date of the event notify the village clerk of the hours, nature and location of the proposed event or class. Any such event or class shall be subject to review and approval by the local liquor control commissioner, who may in his discretion refer it to the local liquor control commission for review and approval.
5. Entertainment may be allowed in conjunction with any such event or class for no additional fee, provided, the hours and acceptability of any such entertainment shall be subject to the prior approval of the local liquor control commission.
6. The holder of a class I license shall not sell, offer, deliver, or permit to be sold, offered for sale, given away or delivered, any alcoholic liquor except between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) midnight on any day; provided, the local liquor control commission may further limit the sale, offering for sale, giving away, and/or delivering of alcoholic liquors for any particular event or class specified by the park district in its annual application for such license or otherwise.
7. The local liquor control commission may as a condition of approval of such license impose any other restrictions, limitations, or conditions under which such event or class may be conducted pursuant to such license.
O. Class J License: Video Gaming Cafe
1. A Class J license shall be for the sale at retail of alcoholic liquors, on the premises only, and specifically within the building located on the premises, provided the licensed premises also has, maintains and lawfully operates video gaming terminals (as defined under the Illinois Video Gaming Act, 230 ILCS 40/1 et seq.) within the licensed establishment.
2. A Class J license shall be issued to premises located only within one of the following Zoning Districts:
a. B-1 Central Business District
b. B-2 Community Business Zoning District
c. B-3 Service Business Zoning District
3. The annual fee for a Class J license shall be as set from time to time by the Board of Trustees; provided, the license fee may be refunded if a license for video gaming terminals for the prospective licensee is denied after issuance of such liquor license, also provided the Village shall retain two hundred dollars ($200.00) as an administrative fee therefor; and otherwise, the license fee once paid shall not be refundable or prorated.
4. Establishments or premises holding a Class J liquor license shall close each night at twelve o'clock (12:00) midnight, except that on Friday and Saturday night they shall close no later than one o'clock (1:00) A.M. the following day, and they shall be closed at the following times each week: twelve o’clock one minute (12:01) A.M. through six o’clock (6:00) A.M. on Monday through Friday, and one o’clock (1:00) A.M. through six o'clock (6:00) A.M. on Saturday and Sunday.
5. Food and food products may be prepared on site and offered to customers on the premises of a Class J license during all hours of operation, subject to applicable building, health, and safety regulations. For purposes of this regulation, "prepared" shall mean assembly, cooking, and preparing of original ingredients, as well as of frozen or pre-packaged items, for service to and consumption by customers, on the premises. The license holder may utilize a food preparation area; a cooler and/or freezer; a convection oven, and/or a microwave oven for such preparation of food.
6. No person under the age of twenty-one (21) shall be allowed on the licensed premises at anytime.
7. Live music, DJ's, and/or karaoke events, and/or jukeboxes are prohibited on the licensed premises. Notwithstanding the foregoing, an internal music system, operated solely by the licensee, shall be permitted so long as such system is operated at a level of volume so as to not be heard outside the licensed premises.
8. There shall be no outdoor patio or beer garden, or any outside seating of any kind, for patrons.
9. No games, other than the video gaming terminals as defined under the Illinois Video Gaming Act, 230 ILCS 40/1 et seq., shall be permitted on the licensed premises, including, but not limited to, pool, darts, shuffleboard or any coin-operated amusement device.
10. The holder of a Class J license shall during all hours of operation provide and operate video surveillance equipment covering the area occupied by video gaming machines on the premises.
11. If the building space licensed for and occupied by the holder of a Class J license is located within or shared with another business, then the licensed space must be fully segregated by walls extending from floor to ceiling and must have a separate outside entrance. The retail sale and consumption of alcoholic liquor may take place only within said licensed and segregated space.
P. Late Hours: Licensees holding class A-1, A-2, C-1, C-2, D, E, F and J licenses shall be allowed to stay open until two o'clock (2:00) A.M. on the morning immediately following New Year's Eve only.
Q. Sales Promotional Event: Upon application for an approval of a permit therefor, the holder of any valid liquor license in the village may conduct a sales promotional event, such as a tasting or sampling session, for a duration not to exceed three (3) hours on any one day, and subject to such other restrictions and conditions as the Liquor Commission may impose in the permit.
1. The applicant for such permit shall complete a proper application form, and file same with the Village Clerk, not less than thirty (30) days prior to the date of issuance of the permit.
2. The application shall specify the date and time, and the sponsor or participating vendor (if any), and any pertinent conditions under which said sales promotional event shall be conducted.
3. Any sales promotional event permitted under this subsection shall take place only indoors and within the hours of operation otherwise permitted to the license holder.
4. No license holder shall be entitled to more than six (6) permits for a sales promotional event in any one calendar year, and not more than one in any calendar month.
5. Entertainment shall be allowed in the establishment and/or on the premises of the license holder during any sales promotional event, but the acceptability of any such entertainment shall be subject to review by and approval of the Liquor Commission.
6. An appropriate certificate of insurance, covering the dispensing of alcoholic beverages for consumption on site, must be filed with the Village Clerk.
7. Any person or persons who will be dispensing alcoholic beverages during the special event shall apply for a bartender permit and shall pay the applicable bartender license fee to the Village prior to the event, unless otherwise excused by the Liquor Commission.
8. The Liquor Commission may impose such other conditions and/or restrictions on any permit for a sales promotional event as it deems reasonable or necessary.
R. Number Of Licenses: The number of alcoholic liquor licenses to be issued in the Village shall be as follows:

S. Product Sampling and Product Tastings.
1. The holder of any valid liquor license in the Village may engage in product sampling on the licensed premises, in accordance with state law, 235 ILCS 5/6-31, provided:
a. All license holders and employees of such license holders engaging in such product sampling shall comply with the requirements for an "employee" under §§ 3-1-14 and 3-1-15 of the Village Code, and specifically, shall have BASSETT training; provided, any distributor or importing distributor engaging in such product sampling in the Village need not obtain such BASSETT training; and
b. The hours for product sampling in any licensed liquor establishment may be limited by the Local Liquor Control Commissioner; and
c. For purposes of this Section R, an "on-premises retail licensee" per 235 ILCS 5/6-31(b) shall mean the holder of any A-1, A-2, C-1, C-2 or C-3 liquor license in the Village.
2. The holder of any valid liquor license in the village for sale at retail of products in the original package for consumption off the premises (an "off-premise licensed retailer") may engage in product tastings.
a. For purpose of this section, "tasting" means "a supervised presentation of alcoholic products to the public at an off-premise licensed retailer" conducted for the purpose of disseminating product information and education, with consumption of alcoholic products being an incidental part of the presentation, in compliance with the requirements of the Illinois Administrative Code, Title 11, Section 100.10 et seq.
b. All license holders and employees of such license holders engaging in such product tastings shall comply with the requirements for an "employee" under §§ 3-1-14 and 3-1-15 of the Village Code, and specifically, shall have BASSETT training; provided, a registered tasting representative engaging in such product tasting need not obtain such BASSETT training; and
c. The hours for product tastings in any licensed liquor establishment may be limited by the Local Liquor Control Commissioner; and
d. For purposes of this sub-section R(2), a "off-premises licensed retailer" per Illinois Administrative Code, Title 11, §100.10 shall mean the holder of a Class B-1 or Class B-2 liquor license in the Village.
