A. Applications for alcoholic liquor licenses shall be made to the local liquor control commission, which shall have authority to grant, deny, suspend or revoke all such licenses. Applications shall be available from the village clerk during regular business hours. Such applications shall be made in writing, and shall be signed by the applicant, if an individual, or by a duly authorized agent thereof, if a club or corporation or other entity, verified by oath or affidavit, and shall contain the following information and statements: (Ord. 16-11, 4-7-2016)
1. The name, age, and address of the applicant in the case of an individual; in the case of a copartnership, the persons entitled to share in the profits thereof; and in the case of a corporation for profit or a club, the date of incorporation, the object for which it was organized, the names and addresses of the officers and directors, and, if a majority in interest in the stock of such corporation is owned by one person or his nominee, the name and address of such person.
2. The citizenship of the applicant, his place of birth and, if a naturalized citizen, the time and place of his naturalization.
3. The nature of the business of the applicant; and in case of a corporation, the objects for which it was formed.
4. The length of time that said applicant has been in said business; or in the case of a corporation, the date on which its charter was issued.
5. The location and description of the premises or place of business which is to be operated under such license.
6. A statement whether applicant has made similar application for a similar alcoholic liquor license on premises other than described in the application, and the disposition of such application.
7. A statement that the applicant has never been convicted of a felony and is not disqualified to receive a license by reason of any matter or thing contained in this article, laws of this state or provisions of this code.
8. Whether a previous license by any state or subdivision thereof, or by the federal government, has been revoked and the reasons thereof.
9. A statement that the applicant will not violate any of the laws of the state of Illinois or of the United States, or any provision of this code in the conduct of his place of business.
10. A site plan for the parcel on which the premises is located, and a floor plan of the interior of the premises, drawn to scale; provided, that any application for renewal of an existing license need be accompanied by a site plan or floor plan only in the event either has changed since the original application or last renewal thereof. 11. A copy of the certification of BASSET training for each person who will sell or serve alcoholic beverages and/or whose job description includes checking identifications for the purchase of alcoholic beverages at retail or for entry into the licensed premises of a liquor establishment in the village. B. All applications for alcoholic liquor licenses for such classes of licenses allowing entertainment therein shall be subject to review by the local liquor control commission as to the acceptability of such entertainment.
C. All applications for alcoholic liquor licenses shall be accompanied with the appropriate fees as designated herein and a surety bond to the village executed by the applicant and by good and sufficient surety, to be approved by the local liquor control commission, which bond shall be in the sum of one thousand five hundred dollars ($1,500.00), and conditioned that the licensee shall faithfully observe and conform to all state laws and all provisions of this article and any and all hereafter passed during the period of said license, and conditioned further for the payment of any and all fines levied against such licensee for the violation of any of the terms and conditions of this article and any amendments thereto, or state law, and shall be further conditioned that the licensee shall pay all the necessary costs and charges incurred by reason of the revocation or suspension of his license herein.
D. Applications for alcoholic liquor licenses and renewals of licenses shall be considered in the same order in which they are received by the village clerk; however, no such application shall be considered filed and received until accompanied by the appropriate fee and surety bond. Failure to make an application for a renewal license thirty (30) days or more before the expiration date of the license shall be deemed a waiver of priority.
E. Any licensee may renew his license at the expiration thereof; provided, that he is then qualified to receive a license and the premises for which such renewal is sought are suitable for the purposes, that he has met all of the application requirements herein, and provided further, that the renewal privilege herein described shall not be construed as a vested right which might prevent the village president and board of trustees from decreasing the number of licenses to be issued within the village.
F. Any application for an alcoholic liquor license which has been filed with the village clerk on or before December 1 shall be reviewed, in form, by the local liquor control commission prior to the issuance of licenses for the term commencing on January 1 of the following year.
G. The local liquor control commission may require any applicant for a new or renewal alcoholic liquor license to be fingerprinted, pursuant to the Illinois liquor control commission rules and regulations. (Ord. 97-30, 9-18-1997)
