A. If an individual uses a name or symbol specified in this article without first obtaining the permission of the Mayor and Council, that person shall be deemed to have violated this article and shall be subject to one or more of the following: a fine of not more than $1,000, imprisonment for a period not to exceed 90 days or a period of community service not to exceed 90 days.
B. The sentence, upon conviction, shall be within the discretion of the judge presiding over the matter. In addition to the penalties above, the judge shall issue an order that the individual or organization shall immediately cease all fundraising activities. If any individual or organization is found to have engaged in such activities after being ordered to cease, the individuals may be subject to the same penalties specified above upon conviction.
