§ 32.05 HAMILTON LAKE CONSERVANCY DISTRICT II.
   (A)   Pursuant to the provisions of I.C. 14-33-l et seq., the town hereby authorizes the filing of a petition with the Steuben County Circuit Court to establish the Hamilton Lake Conservancy District II for the following purposes:
      (1)   Developing forest, wildlife areas, parks, and recreational facilities if feasible in connection with beneficial water management; and
      (2)   Operation, maintenance and improvement of:
         (a)   A work or improvement for water-based recreational purposes; or
         (b)   Other work or improvement that could have been built for any other purpose authorized by I.C. 14-33-1-1.
   (B)   The proposed district shall include land partially inside and partially outside the corporate limits of the town, as permitted by I.C. 14-33-2-7.
   (C)   The creation of the Hamilton Lake Conservancy District II is necessary in order to comply with the purposes stated in division (A) above.
   (D)   The creation of the Hamilton Lake Conservancy District II will be made possible in part through the assistance of state monies and annual assessments upon the landowners who benefit from the project.
   (E)   The local portion of construction costs and the expenses of maintenance and operation of the works of improvement necessary to accomplish any and all of the purposes will be paid by annual assessments on each parcel of land located within the Hamilton Lake Conservancy District II territory.
