§ 152.21 PROCEDURE FOR APPROVAL OF PRELIMINARY PLAT.
   (A) The subdivider shall cause to be prepared a preliminary plat together with improvement plans and other supplementary material as specified in the following sections.
   (B)   Five copies of the preliminary plat and supplementary material specified shall be submitted to the Secretary of the Plan Commission with written application for approval.
   (C)   The Town Council may set fees to cover the cost of the public hearing and checking the plat proposal. The fee shall be due at the time of filing for approval of the preliminary plat, and the current fee is established at $100.
   (D)   A public hearing shall be held before the Plan Commission. At least ten days prior to the day set for the hearing, the Plan Commission shall notify the applicant in writing, notify the general population by publication in a newspaper of general circulation in Steuben County and DeKalb County, Indiana, and notify any governmental unit having a probable interest in the proposed plat, that a hearing will be held.
   (E)   (1)   After the public hearing and following review of the preliminary plat and other material submitted for conformity thereof to these regulations and negotiations with the subdivider on changes deemed advisable and the kind and extent of improvements to be made by him, the Plan Commission shall, within 30 days of the public hearing, act thereon as submitted or modified, and if approved, the Plan Commission shall express its approval. The conditions of the approval, if any, or if disapproved, shall express its disapproval and its reasons therefore.
      (2)   The action of the Plan Commission shall be noted on four copies of the preliminary plat referenced and attached to any conditions determined. One copy shall be returned to the subdivider, one copy forwarded with a report to the Town Council and one copy retained by the Plan Commission. Within the jurisdictional area, one additional copy shall be forwarded to the County Surveyor.
