(A) If the Plan Commission finds that the public would be materially injured or any affected property owner would be materially injured by the relief sought by the petitioner, or that the proposed improvements are or would not be located entirely within the platted right-of-way for such street, then the Plan Commission shall recommend denial of the petition. If the Plan Commission finds that the public would not be materially injured nor any affected property owner materially injured, and that the proposed improvements are entirely within the platted right-of-way for the street, then the Plan Commission shall recommend approval of the petition.
(B) The Plan Commission shall submit its recommendation to the Town Council and the Town Council shall take action upon the recommendation at its next regularly scheduled meeting.
