(A) Any person desiring to change the location of an existing street which is not located according to its plat or desiring to improve and develop an unimproved but platted street shall be prohibited from doing so except as provided in this subchapter.
(B) The person shall complete an application/petition and submit it to the Hamilton Plan Commission through the office of the Clerk-Treasurer. The application shall show, at a minimum:
(1) The name of the street;
(2) The general description of the length and width of that portion of the street to be improved and/or relocated expressed in terms of feet and referencing intersections with other streets or other landmarks;
(3) A specific description of the type and nature of all the improvements to be made;
(4) An estimate of the cost of the proposed improvements, which estimate shall be prepared by a contractor regularly doing business in street improvements, such as grading, paving, etc.,
(5) A complete and accurate list of the names and mailing addresses of all owners of property abutting that portion of the street to be improved, which list must be certified under oath as being accurate; and
(6) A true and accurate copy of the plat, including the protective covenants and dedications, of the subdivision addition in which the street is located;
(7) The application/petition shall be accompanied by a survey done by a registered land surveyor licensed in compliance with the laws of the state showing the location of the street as platted, the actual location and dimensions of the existing improved street, and the location and dimensions of the proposed improved street. The submission of the application and other documents required by this division is a prerequisite to the Plan Commission taking any further action pursuant to this subchapter.
