(A) The Town Marshal and all deputy marshals (collectively referred to in this section as the Town Marshal) shall have the power and authority to impound any animal found running at large. The Town Marshal shall in addition have the authority to cause the animal to be transported to and held by any humane shelter operating with Steuben or DeKalb County for any required period of detention in the case of an animal bite or for such other period consistent with the rules and regulations of the shelter. Upon expiration of the period, the humane shelter shall take such action for the disposal of the animal as is consistent with its rules, regulations and procedures.
(B) An animal that has been impounded by the Town Marshal is not to be released to the owner unless a detention fee of $25 has been paid by the owner to the town and also the fees and costs customarily charged by the shelter or incurred by the shelter have been paid in full by the owner.
(C) The Town Marshal shall keep accurate records of the impounding and releasing of animals and the records shall be examined annually by the Town Council.
