§ 31.61 BAND COMMISSION.
   (A)   Band Commission. There is hereby created by the City Council a Commission to be known as the City Band Commission. This Commission shall consist of five persons appointed by the Mayor at the beginning of each year, with the approval of the City Council. In so appointing the members of the Band Commission, the Mayor and the City Council shall appoint a Chairperson, and the Band Commission shall annually select its Vice Chairperson and Secretary.
   (B)   Municipal Band Tax. The tax which is levied by the city for the municipal band, pursuant to Ord. 11 (Series 1951-1952), shall be maintained by the City Clerk and held as funds available for the operation of the municipal band by the Band Commission.
   (C)   Commission’s duties. The Commission shall have the following duties:
      (1)   Prior to adoption of the Appropriation Ordinance, the Commission shall annually present to the City Council its recommendations for annual appropriations for the City Band Commission;
      (2)   Supervise and authorize the expenditures of funds from the Municipal Band Tax and rentals and other revenues, and all expenditures of said fund shall first be recommended by the Band Commission to the City Council and shall be expended only upon authorization by the City Council;
      (3)   Supervise the summer band program;
      (4)   Authorize use of the city band instruments by students of School District No. 328, establishing appropriate rental arrangements and provisions for insurance on said instruments with the city as the named insured, all such rental fees to be paid into the Band Fund of the city for the use of the Band Commission as above described;
      (5)   Arrange for summer band lessons and concerts by the municipal band through cooperation with the school district utilizing the high school band, the middle school band, the beginning bands, and community adults and arrange for a Summer Director of the municipal band;
      (6)   Supervise the maintenance and repair of all city band instruments by presentation of proposals for same to the City Council, same to be authorized as provided in division (C)(3) above;
      (7)   Within 30 days after appointment each year, file with the City Clerk a written inventory of all city-owned band instruments in the possession of the Commission or the school district, annually updating said inventory by adding to it instruments purchased during the year and deleting from the instruments discarded, if any; and
      (8)   The Band Commission shall meet at least four times each year, all such meetings to be held at the City Hall, during fiscal year 1990, and as established by the Band Commission thereafter.
   (D)   Annual plan for summer concerts. Prior to June 15 of each year, the Band Commission shall file with the City Clerk and the Mayor a written plan providing the following information: the name of the Summer Band Director, the dates and times of summer band concerts, and such other information as the Band Commission deems appropriate.
