Whoever, being the owner or agent of the owner of any land located within the city (knowingly or with intent to defraud), transfers or sells, by reference to or exhibition of or by other use of, a plat of subdivision of such land before such plat has been approved by the City Council shall, upon conviction, forfeit and pay the penalty of not less than $25 nor more than $100 for each day such violation exists for each lot so transferred or sold or agreed or negotiated to be sold, and a description by metes and bounds shall not exempt the transaction from such penalties.
