(A) Purpose. The purpose of this section is to protect the public from unsafe structures and prevent any detrimental devaluation of neighboring properties because of neglect, abandonment, or other conditions causing a nuisance due to the condition of said property.
(B) Definition.
(1) The term DILAPIDATED STRUCTURE shall mean any building, residence, or other structure which:
(a) Cannot be utilized for the original intended purpose for which it was constructed such as a domicile, garage, business, storage building, or other use;
(b) Contains on the exterior surface, due to damage or deterioration, holes or openings in the floors, external walls, or roof;
(c) Has one or more windows or doors deteriorated or been damaged so as to allow the unrestricted entry of wind, precipitation, animals, or persons;
(d) Has any floor, wall, roof, porch, overhang, foundation, rafter, sill, beam, or other part of such structure that is loose, tipped, tilted, or otherwise structurally unsound or in danger of falling or collapsing;
(e) Has suffered the structural integrity or contiguity to become dilapidated, deteriorated, or damaged to a point that the building or structure or any portion thereof is loose, tipped, tilted, broken, cracked, open, or otherwise structurally unsound or in danger of falling or collapsing;
(f) Due to damage or deterioration from fire, wind, storm, or other cause, has become weakened so as to be loose, tipped, tilted, broken, cracked, open, or otherwise structurally unsound or in danger of falling or collapsing;
(g) Contains either rats, rodents, or other vermin or wild animals other than mice;
(h) Is a residential structure which, because of damage or deterioration or other cause, has become uninhabitable or unfit for human habitation; or
(i) Is a business or commercial building that has been damaged or has deteriorated so as to be unacceptable or unusable for its intended business or commercial purpose or for any business or commercial purpose.
(2) All such residences, buildings, or structures are hereby declared to be a nuisance and in violation of this section.
(C) Nuisance prohibited. From and after the effective date of this section, it shall be unlawful, within the city for the owner or person in possession of any premises to allow the existence of a dilapidated residence, building, or other structure or nuisance thereon as defined herein.
(D) Nuisances nonexclusive. Nuisances enumerated in this section shall not be deemed exclusive but are in addition to and to be construed in conjunction with any other nuisances enumerated in statutes or other provisions of the code or ordinances of the city.
