(A) Mayor’s signature. All ordinances passed by the City Council shall, before they take effect, be deposited in the office of the City Clerk; if the Mayor approves thereof, he or she shall sign the same, and such as he or she shall not approve, he or she shall return to the Council with his or her objections thereof, in writing, at the next regular meeting of the Council occurring not less than five days after the passage thereof. Such veto may extend to any one or more items or appropriations contained in any ordinance making an appropriation or to the entire ordinance, and in case the veto shall extend to a part of such ordinance, the residue thereof shall take effect and be in force. In case the Mayor shall fail to return any ordinance with his or her objections thereto by the time aforesaid, he or she shall be deemed to have approved such ordinance, and the same shall take effect accordingly.

(B) Overruling Mayor’s veto. Upon the return of any ordinance by the Mayor, the vote by which the same was passed shall be reconsidered by the Council; and if, after such reconsideration, two-thirds of all the members elected to the City Council shall agree, by yeas and nays, to pass the same, it shall go into effect, notwithstanding the Mayor may refuse to approve thereof. The vote to pass the same over the Mayor’s veto shall be taken by yeas and nays and entered on the journal.

(C) Legislative powers. The Council has and shall exercise all legislative powers and duties conferred upon the city or its officers. It shall make all orders for the doing of work or the making or construction of any improvements, bridges, or buildings. It shall levy all taxes and appropriate all funds; audit all bills, accounts, payrolls, and claims; and order payment thereof. It shall make or authorize the making of all contracts, and no contract shall bind or be obligatory upon the city unless reduced to writing and approved by the Council or expressly authorized by ordinance or resolution adopted by the Council. All officers, assistant superintendents, and employees having discretionary or supervisory powers are only agents of the Council, and all of their acts shall be subject to review and to approval or rejection by the Council. Every officer, assistant superintendent, or employee having discretionary or supervisory powers shall report from time to time, as required by law or ordinance or whenever requested by the Council or by the committee in charge of the department to which such report relates or when the committee shall deem it necessary for the good of the public service, to the Council, in writing, regarding the business of its division or office or the matters connected therewith.
