§ 94.02 HAMILTON COMMUNITY CENTER.
   (A)   The City Community Center shall be made available to the public according to the rules established in this section.
   (B)   The Center shall be made available to the public upon application and approval by the City Clerk or Clerk’s designee on the form attached.
   (C)   The following rules shall apply to the use of the Center.
      (1)   Upon payment of the appropriate fees and the cleanup/damage deposit and approval by the City Clerk or Clerk’s designee, the Center shall be reserved for the applicant’s time and date, as shown in the application.
      (2)   It shall be the duty of the City Clerk or Clerk’s designee to maintain a calendar showing the dates and times of all events for which an application has been approved.
      (3)   No reservations shall be registered by the Clerk or Clerk’s designee until the cleanup/damage deposit has been paid in full.
      (4)   The Clerk or Clerk’s designee shall refund any applicant’s fees, retaining a $25 service fee upon cancellation in writing, if the cancellation is delivered to the Clerk or Clerk’s designee 72 hours prior to the reserved time.
      (5)   Applicants shall deposit a refundable cleanup/damage fee of $75. This fee shall be refunded to the applicant if the city incurs no cleanup costs and no damage occurs. Applicants shall be liable for any damage or cleanup cost including any such cost in excess of the deposit. A city representative must inspect the Center before and after a rental to inspect for cleanliness and damage.
      (6)   The Center shall be available during the following hours:
         (a)   Sunday through Thursday: 5:00 a.m. through 10:00 p.m.; and
         (b)   Friday and Saturday 5:00 a.m. through midnight.
      (7)   The Center shall not be used in any manner to disturb the neighborhood. No loud noise or loud music shall be allowed after 10:00 p.m. on Sunday through Thursday rentals and midnight on Friday and Saturday rentals.
      (8)   No illegal activities of any kind shall be conducted on the premises.
      (9)   The premises are open to inspection at any time during any event by representatives of the city, including the city police.
      (10)   Rental fees for the use of the Center are as follows:
         (a)   For the big hall and kitchen for three hours or less: $75;
         (b)   Per day for the big hall and kitchen: $125; and
         (c)   For the small room and kitchen: $75.
      (11)   The rent and damage deposit must be paid in full when the keys are picked up at City Hall. The City Council reserves the right to waive the fee.
      (12)   Pursuant to 235 ILCS 5/6-15, no alcoholic liquors shall be sold or delivered at the Center by any applicant or person attending any event sponsored by any applicant except that alcoholic liquor may be sold or delivered by applicants only if the applicants shall provide dram shop liability in maximum insurance coverage limits so as to save harmless the city from all financial loss, damage, or harm. Applicants shall indemnify the city from all such financial loss or harm. Applicants are not authorized, pursuant to any application, to use the center to sell or deliver any liquor or alcoholic beverages unless and until an insurance certificate naming the city as an insured is filed with the City Clerk or Clerk’s designee.
      (13)   City senior citizens may utilize the facility at all times without charge, except during times reserved for any applicant.
