§ 91.32 BUILDING CONSTRUCTION WITHIN FIRE LIMITS.
   (A)   Ironclad buildings. No wooden building or other building, the walls of which are covered by iron or other material, commonly known as IRONCLAD BUILDINGS, shall be constructed within that part of the fire limits above indicated between the north side of the alley running east and west between Broadway and Oak Streets and the south side of the alley running east and west between Broadway and Walnut Streets nor shall any wooden building now within the said fire limits that may become damaged by fire or storm be repaired with combustible material when said damage, in the opinion of the Council, shall amount to more than 50% of the building at the time of such damage; provided, nothing in this section shall be construed to prohibit the erection of a frame building, the outside of which shall be veneered with brick or covered with stucco.

   (B)   Exception to prohibition of fire limits. Notwithstanding the prohibition contained in division (A) above, said provision shall not be a prohibition to the construction of any ironclad building so long as no part of the structure proposed to be constructed is closer than 40 feet to the nearest property line of the nearest contiguous, adjacent, or closest lot owner, said measurement to include only that portion of the distance included on the construction applicant’s property and any contiguous streets, alleys, or other public grounds.
