§ 11.37 ELECTION RESULTS.
   (A)   Ties. The person having the highest number of votes for any office shall be declared to be elected. In case of a tie in the election of any city officer, it shall be determined by lot in the presence of the City Council, in such manner as they shall direct, which candidate or candidates shall hold the office.

   (B)   Notification of elected party. It shall be the duty of the City Clerk, within five days after the result of any election is declared or appointment made by the Council to notify, in writing, all persons nominated, elected, or appointed to office of their nomination, election, or appointment, and if any such person shall fail to qualify within ten days after such notice, the office shall become vacant.

   (C)   Failure to elect. If there is a failure to elect any officer herein required to be elected or the person elected should fail to qualify, the City Council may forthwith order a new election therefor and, in all cases, when necessary, may call such elections, appoint Judges and Clerks thereof, canvas the returns thereof, and provide, by ordinance, for the mode of conducting the same and shall give notice of such special elections in which shall be stated the questions to be voted upon and cause such notices to be published or posted for the same length of time and in the same manner as is required in the case of regular elections.

   (D)   Commencement of terms after election. The term of all elected municipal officials shall commence at the first regular or special meeting of the corporate authorities in the month of May following such election.
