§ 52.04 ADOPTION OF SOLID WASTE STUDY.
   (A)   Approval of Solid Waste Plan. The city accepts and gives its approval to the Solid Waste Plan entitled “The Southeast Iowa/Hancock County, Illinois, Regional Solid Waste Study (Phase III),” as adopted by the County Board and approved by the State Environmental Protection Agency.
   (B)   Municipal lead agency. In order to implement the Solid Waste Plan and to effectuate the purposes of the Solid Waste Plan in regard to environmentally sound waste disposal, the city hereby designates the county as a municipal lead agency which may exercise all the powers of a municipal joint action agency, as set forth in §§ 3.2 and 3.2a of the Intergovernmental Cooperation Act.
   (C)   Powers of municipal lead agency. The county, being a municipal lead agency, the County Board may exercise the following powers:
      (1)   Adopt such ordinances which require that all or any portion of municipal waste generated within the county, including that within the city, be delivered to a transfer station or landfill designated by the county;
      (2)   Adopt such ordinances which require that all persons engaged in the business of hauling or transporting municipal solid waste, including those so engaged in the city, obtain a waste hauler’s license from the County Board; and
      (3)   Adopt and implement such recycling programs necessary to comply with state-imposed recycling mandates.
