§ 97.09 ABANDONMENT PROHIBITED; NOTICE TO FILL; LIEN.
   The abandonment by the owner or the person, firm, or corporation having control of any parcel of land situated in the town, of any cesspool, well, dry well, spring or excavation located on the land that is or that may become a hazard to life and limb is prohibited. If any owner or the person, firm, or corporation having the control of any such parcel of land shall fail or neglect to cover or fill in and grade the abandoned cesspool, well, dry well, spring or excavation within 48 hours of the receipt of notice to do so from the Legislative Council or its agent, then the Legislative Council shall cause the abandoned cesspool, well, dry well, spring or excavation to be covered or filled in and graded, and the expense so incurred shall be a lien in favor of the town upon such property until paid, and the amount of the expense may be recovered in an action in the name of the town.
