(A) There is hereby established the ARP Coronavirus Local Fiscal Recovery Fund (Fund 176).
(B) The Clerk-Treasurer of the Town of Hagerstown is hereby empowered to receive and deposit funds related to the ARP Coronavirus Local Fiscal Recovery Fund into an account maintained by a financial institution named by the town as a depository.
(C) Any and all monies received from the ARP shall be receipted into Fund 176 and uses of the same are restricted, as follows:
(1) Any and all uses as specified in § 603(c) of the ARP;
(2) Any and all funds shall be used to provide payment in accordance with § 603(c) of the ARP to cover costs incurred by the town by December 31, 2024;
(3) Funds may be used to respond to the public health emergency caused by COVID-19 or the economic effects from COVID-19, including assistance to households, small businesses, and non-profits, or to aid impacted industries such as tourism, travel, and hospitality;
(4) Funds may be used to provide premium pay to eligible workers who perform essential work;
(5) Funds may be used to provide grants to eligible employers of eligible workers who perform essential work;
(6) Funds may be used for the provision of governmental services to the extent of the reduction in revenue of the town due to the COVID-19 public health emergency compared to revenue collected in the most recent fiscal year of the town prior to the COVID-19 public health emergency;
(7) Funds may be used to make necessary investments in water, sewer, or broadband infrastructure; and
(8) Funds may be used for the town’s ARP Plan, to be discussed, approved and adopted at a subsequent public meeting of the town, that will provide additional details for the use of these funds.
(D) To ensure accountability and transparency in the use of the funds, the Clerk-Treasurer shall not transfer any funds to another fund of the town.
(E) Prior to the disbursement of any funds, the town’s fiscal body shall appropriate the money in the fund for a use consistent with those set forth above.
