7-1-3: STREET CUTS AND RESTORATION; PERMIT AND BOND:
   A.   Street Cutting Permit Required: It shall be unlawful for any person to cut or make cuts in any street or in any paved alley for the purpose of making sewer connections, water connections or otherwise without first obtaining a street cutting permit.
   B.   Restoration Of Pavement:
      1.   Where a paved street or alley is cut, the restoration of the pavement shall be made by and at the expense of the person cutting the street or alley.
      2.   Franchised utilities may, at the approval of the engineer, contract with others within the city to restore pavement. All costs of pavement shall be at the expense of the utility.
   C.   Specifications: All street and alley cuts shall be made in accordance with the specifications hereby adopted as "Regulations For Cutting Streets And Alleys", copies of which shall be on file at all times in the office of the city clerk-treasurer.
   D.   Permit Fee And Performance Bond: A permit fee shall be charged at the time a permit is issued. The applicant shall also obtain a performance bond sufficient to cover the cost of the cut to ensure compliance with this section, which will be returned after restoration is properly made, as determined by the city. The cost of the permit fee and deposit shall be set by resolution of the city council. (1996 Code § 6-1-6)
