§ 38.03 MEMBERSHIP.
   (A)   The Mayor of the city shall appoint residents of the city as members to the Planning Commission.
   (B)   The City Council shall approve the appointments made by the Mayor.
   (C)   The initial appointments will be on staggered terms as follows.
      (1)   Each Planning Commission member shall be appointed to a four-year term, except for the initial term.
      (2)   The initial appointment by the Mayor confirmed by City Council shall be on a staggered basis as follows: one member four-year term, one member three-year term, one member two-year term and two members one-year term.
   (D)   Where extraterritorial jurisdiction is consented to by the county, the county will be provided one member to serve on the Planning Commission. The member shall be appointed by the County Judge Executive and approved by Fiscal Court.
   (E)   Vacancies within the Planning Commission shall be filled within 60 days by the Mayor and City Council.
      (1)   If the Mayor or City Council fails to act within the time provided, the Planning Commission may fill the vacancy.
      (2)   When a vacancy occurs, other than through the expiration of term of office, it shall be filled for the remainder of the term remaining.
   (F)   The removal of a member of the Planning Commission shall be by the Mayor and approved by the City Council and should follow the procedure as outlined in KRS Chapter 100.157.
   (G)   The members of the Planning Commission shall serve without compensation for their services rendered.
   (H)   Each member of the Planning Commission before entering their duties shall be administered the oath of office as provided by the laws of the commonwealth.
   (I)   The Planning Commission shall elect on an annual basis, a Chairperson and a Vice-Chairperson.
      (1)   The Chairperson and Vice-Chairperson shall be citizen members.
      (2)   A citizen member is defined as a member of the Commission who is not an elected official.
      (3)   Each citizen member shall be eligible for re-election at the expiration of their term.
