(A) The Planning Commission shall have jurisdiction within the area of annexed property creating the city. Any subsequent annexations by the city, increasing their territorial jurisdiction, will also be covered by the Planning Commission.
(B) The Planning Commission, through a request made by the City Council, may request extraterritorial jurisdiction for the purposes of subdivision regulation and/or any other regulations up to five miles beyond all points of the city’s boundaries. The extraterritorial jurisdiction will be at the consent of the County Fiscal Court and will not extend beyond the county boundary and/or state boundary.
(C) Any conflict for extraterritorial jurisdiction with any other planning unit shall be resolved per KRS 100.131.
