§ 154.163 COMPLETION OF PENDING CONSTRUCTION.
   Nothing contained in this chapter shall be interpreted as requiring any change in the plans, construction, alteration or designated use of a structure for which a zoning permit has been issued, and the actual construction begun prior to the adoption of this chapter, and completion thereof carried on in a normal manner and not discontinued for reasons other than those beyond the builder’s control. ACTUAL CONSTRUCTION is hereby defined to include the placing of construction materials in permanent position and fastened in a permanent manner. Where excavation or demolition or removal of an existing building has been substantially begun preparatory to rebuilding, such excavation or demolition or removal shall be deemed to be actual construction; provided that, work shall be carried on diligently. However, if the designated use will be non-conforming, it shall be considered a discontinued use if not in operation within one year of the effective date of this chapter, unless an extension is authorized by the Board.
