§ 37.99 PENALTY.
   (A)   Pursuant to Tex. Health and Safety Code § 418.173, convictions for violations of the provisions of §§ 37.15 through 37.21 of this chapter shall be punishable by fine not to exceed $1,000, imprisonment up to 180 days, or both.

   (B)   Any person who shall violate any provision of §§ 37.30 through 37.37 of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished as provided in § 10.99. Each day such violation shall continue or be permitted to continue shall be deemed a separate offense. It shall not be necessary for the complaint to negative any exception contained in §§ 37.30 through 37.37 concerning any prohibited act, but any such exception made in such subchapter may be urged as a defense by any person charged by such complaint.
