§ 31.16 EMERGENCY MEETINGS AND AGENDA ITEMS.
   (A)   The following requirements shall apply to the notice requirements for an emergency meeting or the addition of an emergency item to the agenda:
      (1)   In an emergency or when there is an urgent public necessity, the notice for the meeting, or the supplemental notice for a subject added as an item to the agenda for a meeting for which notice has been posted in accordance with this subchapter, is sufficient if it sets forth the subject matter and is posted for at least two hours before the meeting is convened.
      (2)   An emergency or an urgent public necessity exists only if immediate action is required of a governmental body because of:
         (a)   An imminent threat to public health and safety; or
         (b)   A reasonably unforeseeable situation.
      (3)   The notice shall clearly identify the emergency or urgent public necessity in the notice or supplemental notice under this section.
      (4)   A person who is designated or authorized to post notice of a meeting by a governmental body under this subchapter shall post the notice taking at face value the stated reason for the emergency or urgent public necessity.
   (B)   The Mayor may call an emergency meeting, or an application for an emergency meeting may be submitted by any three council members to the Mayor for approval. The Mayor may approve the request and have a notice posted for one hour prior to the meeting to comply with state law. The meeting may be held and two-thirds majority vote shall be required to declare an emergency exists and abatement action shall be taken as approved by the Council. The Mayor also has the authority to disapprove a request; provided that upon the request of four Council members the Mayor shall approve the request.
   (C)   An emergency does not exist if additional personnel are required on a temporary basis due to vacancies, resignation, illness or vacation situations of this nature are covered in the Personnel Policy Manual.
