A. Definitions And Offense:
1. The term "marijuana" is defined to mean the following: all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin, but shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant or any other compound, manufacture, salt, derivative, mixture or preparation of such mature stalks, except the resin extracted therefrom, fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination.
2. It is unlawful for any person knowingly or intentionally to possess marijuana within the town of Guernsey in an amount totaling three (3) ounces or less.
B. Determination Of Weight: For purposes of determining the weight to be given marijuana under this section, said weight shall include the weight of the marijuana at or about the time it is seized, whether cured or uncured, but excluding packaging material.
C. Penalty For Violation: Any person violating this section shall be charged with a misdemeanor and upon conviction shall be fined in an amount not to exceed seven hundred fifty dollars ($750.00), plus court costs. (Ord. 11-11-001, 12-7-2010)
