4-1-31: COLLECTION OF PET WASTE:
   A.   Collection On Public Property: No person owning or in charge of any dog, cat or other animal shall cause or allow such dog, cat or other animal to soil, defile, defecate on, or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park, or any place where people congregate or walk, or upon any public property whatsoever, or upon any private property, without the permission of the owner.
   B.   Collection On Private Property: Any person owning or in charge of any dog, cat or other animal, which soils, defiles, defecates on, or commits any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park, or any place where people congregate or walk, or upon any public property whatsoever, or upon any private property without permission of the owner of the property, shall immediately remove all feces deposited by such dog, cat or other animal in a sanitary manner.
   C.   Disposal Of Pet Waste: The feces removed from the aforementioned designated areas shall be disposed of by the person owning or in charge of any dog, cat or other animal, in a sealed, nonabsorbent, leakproof container.
   D.   Penalty: The violation of this section by any person is hereby declared to be a misdemeanor.
First conviction: Such person shall be fined any sum not to exceed twenty five dollars ($25.00), plus court costs.
Second conviction: Such person shall be fined any sum not less than twenty five dollars ($25.00) not to exceed fifty dollars ($50.00), plus court costs.
Third conviction: Such person shall be fined any sum not less than fifty dollars ($50.00) nor to exceed one hundred dollars ($100.00), plus court costs. (Ord. 09-07-002, 7-15-2008)
