3-3-5: PROHIBITIONS:
   A.   It shall be unlawful for any person not licensed by the county under section 3-3-6 of this chapter to take, collect or scavenge any recyclable materials set out for licensed collection programs within the county.
   B.   It shall be unlawful for any hauler to dispose of source separated recyclable materials as waste. All source separated recyclables shall be delivered to a processing facility which employs means to recover and market each type of source separated recyclable collected. Any delivery of source separated recyclables directly to a disposal facility or to a transfer station where all materials are bound for disposal will be considered a violation of this chapter.
   C.   It shall be unlawful for any hauler to commingle source separated recyclables with waste on the collection vehicle if the load is not taken to a processing facility which employs means to separate and market each type of recyclable. Source separation is the preferred method of collecting recyclable materials. Haulers which collect recyclables solely through mixed waste collection, where no source separation of recyclables from waste takes place, will not be granted a license under section 3-3-6 of this chapter to collect municipal waste and/or recyclables in the county.
