153.02 RESTITUTION TO CITY FOR DAMAGE TO PUBLIC PROPERTY.
   (a)   Upon the damage and/or destruction to City property, whether due to accidents, vandalism or other criminal acts committed by non-City personnel, the Public Service Director shall determine the amount of restitution owed to the City for the damage and/or destruction of said property. The amount of restitution owed shall be based upon the following:
      (1)   Equipment Rate - Ohio Department of Transportation (primary) or Federal Emergency Management Agency (secondary) schedule of equipment rates.
      (2)   Labor Rate - Base hourly wage rate (by classification), including total fringe benefit costs.
      (3)   Material, Rentals and Contract Services - actual costs paid by the City.
   (b)   After the Public Service Director has determined the final amount of restitution owed to the City based on the criteria set forth in subsection (a) above, he or she shall forward an invoice detailing the same to the Finance Director. The Finance Director shall seek reimbursement from the responsible party or parties.
