(A) Street excavation under this section shall include all excavation of or tunneling under any street owned by the Borough of Grove City. The fee for street excavation shall be as follows:
(1) A permit fee of $50 shall be charged for each street excavation. A degradation fee shall also be charged for each street excavation as provided below.
(2) An inspection fee of $2 for each foot in length (the longest dimension) of each proposed street excavation shall be charged for each excavation.
(3) Performance guarantees shall be required for all street excavations in accordance with the provisions of this chapter.
(B) Right-of-way excavation under this section shall include all excavation of or work in any right-of-way of the Borough of Grove City other than a street, including but not limited to sidewalks and driveways. The fee for right-of-way excavation shall be as follows:
(1) A permit fee of $50 shall be charged for each right-of-way excavation.
(2) An inspection fee of $1 for each foot in length (the longest dimension) of each proposed right-of-way shall be charged for each right-of-way excavation.
(3) A separate permit application and fee shall be required for each proposed right-of-way excavation.
(C) If a single owner proposes to do work that constitutes both a street excavation and a right-of-way excavation, the owner shall be liable for fees under divisions (A) and (B) where applicable.
(D) All fees established above may be changed by resolution of the Borough of Grove City Council. If any part of this section is held illegal or unconstitutional, it is intended that the remaining parts continue in force.
(E) Degradation fee schedule. The degradation fee schedule is below and applies to work as detailed within § 95.038. This fee schedule may be changed by resolution of the Borough of Grove City Council.
