(A) There is hereby established a Resource Recovery and Recycling Program for the mandatory separating of recyclables from refuse and rubbish in the borough.
(1) Separation and storage of recyclables by residences shall be the responsibility of the resident until collection of the same.
(2) Separation, storage and collection of recyclables by commercial, municipal and institutional establishments and community activities shall be the responsibility of each establishment/activity.
(3) Separation and storage of recyclables by commercial “A” establishments shall be the responsibility of each establishment until the collection of the same.
(4) Separation, storage and collection of recyclables by multi-family housing units shall be the responsibility of the owner of the same.
(5) Separation of leaf waste from refuse, rubbish and recyclables shall be mandatory, and the same shall be collected in accordance with regulations established by the borough.
(6) A public information and education program shall be established by the borough.
(B) The Resource Recovery and Recycling Program shall be operated according to the specific program regulations adopted by resolution of the Borough Council. The Borough Council shall have authority to adopt, modify, and amend recycling regulations from time to time by resolution, including, without limitation, regulations regarding which recyclable materials must be recycled and regulations requiring the source-separation of recyclable materials and/or the placement of recyclable materials for collection through single stream recycling. Any regulations so adopted by the Borough Council shall be published at least one time in a newspaper of general circulation in the borough and posted on the borough's website. Violations of any such regulations shall be deemed violations of this chapter and subject to the same penalties hereunder.
