For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALUMINUM CANS. Empty all-aluminum food or beverage containers.
APARTMENT BUILDING. A building containing three or more regulated rental units.
ASHES. The residue from the burning of wood, coal, coke and other combustible materials in homes, places of residence, office buildings, stores and institutions for the purpose of heating and cooking.
BIMETALLIC CONTAINERS. Empty food or beverage containers consisting of steel and aluminum.
COMBUSTIBLE RUBBISH. All rubbish which can be burned and is not recyclable.
COMMERCIAL ESTABLISHMENT. All persons, firms, partnerships, associations or corporations who or which own or operate stores, restaurants, industries, institutions and other similar places, public or private, charitable or noncharitable, which, in the operation of said commercial establishment, has or accumulates refuse and recyclables in and about its premises or elsewhere.
COMMERCIAL-A ESTABLISHMENT. Those establishments used primarily for commercial purposes which generate a maximum average of three 30-gallon trash bags of refuse per week and are served as a residential customer for refuse pickup.
COMMUNITY ACTIVITIES. Events that are sponsored by public or private agencies or individuals that include, but are not limited to, fairs, bazaars, socials, picnics and organized sporting events attended by 200 or more individuals per day.
COMPOST. A mixture of various decaying organic substances such as dead leaves or manure used for fertilizing soil.
CORRUGATED PAPER. Structural paper material with an inner core shaped in rigid parallel furrows and ridges.
DEAD ANIMALS. Includes all dead animals or parts thereof not intended to be used as food for human beings.
DISCONTINUANCE OF GARBAGE SERVICE. The temporary suspension of garbage pickup for a prearranged absence of at least four weeks.
DUMPSTER. A type of large metal bin for refuse, designed to be hoisted onto a specially equipped truck for emptying or hauling away.
DUMPSTER ENCLOSURE. A fence completely surrounding and concealing a dumpster or dumpsters and constructed of approved materials.
ELECTRONIC WASTE. Products as described within the Pennsylvania Covered Device Recycling Act that prohibits the landfilling of televisions, desktop computers, laptops and other electronic items.
FERROUS CONTAINERS. Empty steel or tin coated steel food or beverage containers.
GARBAGE. The by-products of animal and vegetable foodstuffs resulting from the handling or preparation of food or other matter which is subject to decomposition, decay, putrefaction or the generation of noxious or offensive gases and odors, or all refuse or animal or vegetable matter which has been used for food or which was intended to be so used.
GREASE DUMPSTER. A container used for the collection and reclamation of spent or used grease/cooking oil.
HIGH-GRADE OFFICE PAPER. All white paper, bond paper and computer paper commonly used in commercial, institutional and municipal establishments.
HOUSEHOLD HAZARDOUS WASTE. Household products that can catch fire, react, or explode under certain circumstances, or that are corrosive or toxic. Includes, but is not limited to, products such as paints, cleaners, oils, batteries, pesticides, and the like.
INCINERATOR. A furnace or apparatus for burning trash, garbage, and the like to ashes.
INSTITUTIONAL ESTABLISHMENTS. Those facilities that house or serve groups of people in a non-residential setting which include, but are not limited to, hospital,; colleges, schools, day care centers, and nursing homes.
LEAD ACID BATTERIES. Include, but are not limited to, automotive, truck and industrial batteries that contain lead.
LEAF WASTE. Leaves from trees, bushes and other plants; garden residue; chipped shrubbery; and tree trimmings, but not including grass clippings.
METALS. Any of a class of elementary substances such as gold, silver, copper, and the like, all of which are crystalline when solid and many of which are characterized by opacity, ductility, conductivity, and a peculiar luster when freshly fractured; or an alloy or mixture composed wholly or partially of such substances.
MULTI-FAMILY HOUSING PROPERTY. Any property having four or more dwelling units per structure.
NEWSPAPER. Paper of the type commonly referred to as newsprint and distributed at fixed intervals, having printed thereon news and opinions, containing advertisements and other matter of public interest. NEWSPAPER shall expressly exclude glossy advertising inserts often included with newspapers.
NONCOMBUSTIBLE RUBBISH. All rubbish which cannot be burned and is not recyclable.
PERSON. Every natural person, co-partnership, association, corporation or firm.
PLASTICS. All containers with the number one through seven in the recycling symbol on the bottom of the container. Includes all plastic grocery bags.
PREMISES. A tract of land within the borough, including any buildings or structures located thereon, having a county tax I.D. number.
PROPER GARBAGE AND RUBBISH CONTAINER. A container with a handle for lifting or a tightly sealed garbage bag.
RECEPTACLE. A proper container.
RECYCLABLE MATERIALS. Materials having an economic value in the secondary materials market. The following materials have such economic value: aluminum cans and articles, bimetal cans, steel cans, clear and colored bottles and jars, paper (cardboard, office paper, newspaper, paper products not chemically coated). All plastics HDPE, PET, PVC, and the like, including numbers one through seven plastics. The Borough Council shall designate by resolution the recyclable materials eligible for collection within the borough. The Borough Council may amend the list of recyclable materials at its discretion.
RUBBISH. All refuse material not included in "garbage," as hereinbefore defined, except refuse from building construction or reconstruction, street refuse, industrial refuse, dead animals, abandoned large machinery or vehicles or such other refuse materials not commonly produced in homes, stores and institutions.
SCREEN PLANTING. An alive and healthy evergreen hedge sufficient in height to screen the dumpster six feet high, planted in such a way that it will block the line of sight. It may be one or more rows of evergreen bushes or trees.
SCREENING. A fence, screen planting or wall, sufficient in height to screen the dumpster, six feet high, provided in such a way that it will block the line of sight.
