The owner, possessor, caretaker and/or person in control of the said dog at the time it is found to be off the property which the owner, possessor, caretaker or person in control of the said dog resides and the said dog is found not to be on such a leash, which leash is in the control of the said owner, possessor, caretaker and/or person in control of the said dog, or any dog is found to be in an authorized unleashed area without the owner, possessor, caretaker and/or a person in control of said dog present thereat.
