§ 53.102 FEES.
   (A)   Purpose. It is the purpose of this subchapter to provide for the recovery of costs from users of the borough’s wastewater disposal system for the implementation of the program established herein. The applicable charges or fees shall be set forth in the borough’s schedule of charges and fees.
   (B)   Charges and fees.
      (1)   The borough may adopt charges and fees which may include:
         (a)   Fees for reimbursement of costs of setting up and operating the borough’s pretreatment program;
         (b)   Fees for monitoring, inspection and surveillance procedures;
         (c)   Fees for reviewing accidental discharge procedures and construction;
         (d)   Fees for permit application;
         (e)   Fees for filing appeals;
         (f)   Fees for consistent removal (by the borough) of pollutants otherwise subject to federal pretreatment standards; and
         (g)   Other fees as the borough may deem necessary to carry out the requirements contained herein.
      (2)   These fees relate solely to the matters covered by this subchapter and are separate from all other fees chargeable by the borough.
   (C)   Surcharge for high-strength wastewater. There is hereby levied and assessed against each person, industry or corporation discharging high-strength industrial waste into the wastewater treatment plant a surcharge, or surcharges, which are intended to cover such additional cost to the borough. Such surcharges shall be in addition to any regular sewerage service charges and shall be payable as hereinafter provided in the amount hereinafter stipulated.
   (D)   Sampling. The strength of any industrial waste, the discharge of which is to be subject to surcharge, shall be determined quarterly, or more frequently if deemed necessary by the borough, from samples taken as prescribed herein. The frequency and duration of the sampling period shall be such as, in the opinion of the borough, will permit a reasonably reliable determination of the average composition of the said wastes.
   (E)   Suspended solids concentration.
      (1)   In the event any industrial waste is found by the borough to have an average suspended solids concentration in excess of 200 mg/l, the producer of said waste shall be surcharged an amount equal to the product of the actual volume of wastes in thousand gallons per billing period, discharged to the public sanitary sewerage system and the suspended solids surcharge rate. The suspended solids surcharge rate shall be determined by the following formula:
   R = 0.008345 x P(S - 200)
   Where R = the suspended solids surcharge rate in dollars per 1,000 gallons of metered water per quarter.
   P = the prior year’s cost of operating and maintaining the sludge digestion, dewatering and disposal facilities at the treatment works, in dollars per pound of sewage solids received at the treatment plant.
   S = the average suspended solids concentration of the abnormal industrial waste, expressed in parts per milligrams per liter (mg/l).
      (2)   The figure 200 appearing in the above formula corresponds to the maximum suspended solids concentration permissible without surcharge. The figure 0.008345 is the factor to convert parts per million to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having a suspended solids concentration less than 200 parts per million.
   (F)   BOD concentration.
      (1)   In the event any industrial waste is found by the UCC to have an average BOD concentration in excess of 250 mg/l, the producer of said waste shall be surcharged an amount equal to the product of the actual volume of wastes in 1,000 gallons per quarter, discharged to the public sanitary sewerage system and the BOD surcharge rate. The BOD surcharge rate shall be determined by the following formula:
   R = 0.008345 x P (B - 250)
   Where R = the BOD surcharge rate in dollars per 1,000 gallons of metered water per quarter.
   P = the prior year’s cost of operating and maintaining the biological or secondary treatment processes at the treatment plant, in dollars per pound of BOD received at the plant.
   B = the average BOD concentration of the abnormal industrial waste, expressed in milligrams per liter (mg/l).
      (2)   The 250 appearing in the above formula corresponds to the maximum BOD concentration permissible without a surcharge. As before, the figure 0.008345 is the factor to convert parts per million to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having a BOD concentration less than 250 parts per million.
      (3)   For the purpose of assessing surcharges, COD is a surrogate of BOD.
   (G)   TKN concentration.
      (1)   In the event any industrial waste is found by the borough to have an average TKN concentration in excess of 40 mg/l, the producer of said waste shall be surcharged an amount equal to the product of the actual volume of wastes, in thousand gallons per quarter, discharged to the public sanitary sewerage system and the TKN surcharge rate. The TKN surcharge rate shall be determined by the following formula:
   R = 0.008345 x P (T - 40)
   Where R = TKN surcharge rate in dollars per 1,000 gallons of metered water per quarter.
   P = the prior year’s cost of operating and maintaining the biological or secondary treatment processes at the treatment plant, in dollars per pound of TKN received at the plant.
   T = the average TKN concentration of the abnormal industrial waste, expressed in milligrams per liter (mg/l).
      (2)   The figure “40" appearing in the above formula corresponds to the maximum TKN concentration permissible without surcharge. As before, the figure “0.008345" is the factor to convert parts per million per pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having a TKN concentration less than 40 parts per million.
   (H)   Surcharges. The surcharges provided for in this section will be added to any normal sewerage service charges assessed to the user. They will be billed quarterly.
   (I)   Unit cost. The borough shall determine the unit cost surcharge rates, in the surcharge formulas, based on the prior year’s cost of plant operations. After the end of each fiscal year, the borough shall calculate the surcharge rates for the preceding year based on the actual costs for the previous year. When this computation has been made, the surcharge quarterly billing will be made using the preceding year’s actual cost.
