(a) No person shall place or dispose of in any manner any garbage, waste, peelings of vegetables or fruits, brush, leaves, grass clippings, rubbish, ashes, cans, bottles, wire, tacks, nails, glass, paper, cartons, boxes, automobile parts or other junk, glass, oil or other matter of an unsightly, unsanitary or dangerous nature on or along any public street, sidewalk, park or other public grounds or otherwise litter any such street or public grounds.
(b) No person shall place or dispose of such material on any private property without the consent of the owner or the authorized agent of the owner.
(c) No person shall place or dispose of any such material on any unenclosed private property without taking reasonable precautions to prevent such material from being blown or otherwise accidentally removed from the premises, and in no case shall such material be placed or stored between the building setback line of the lot and the street abutting the premises.
(d) No person shall transport junk, refuse or garbage in any manner over and upon any street, alley, road, parkway, park drive or public highway in such a manner that it is strewn upon and along such street, alley, road or public highway.

(e) If any business establishment, in order to function, creates trash items, discarded items or rubbish as described in division (a) of this section, then sufficient containers shall be provided on such establishment which will appropriately enclose such trash. All containers shall be able to be secured to prevent the blowing and littering and shall be emptied sufficiently as to not create a nuisance as established by the Chief Building and Zoning Officer and/or his or her designee.

(f) If dumpsters are required to sufficiently contain such trash, all dumpsters shall have privacy fencing erected around the dumpster which will keep the area from becoming unsightly. Such dumpsters shall be emptied weekly or on a timely basis in order to keep the area free from debris.
(g) The provisions of divisions (a), (c) and (d) of this section shall not apply to action taken in accordance with the requirements or authorization of any ordinance relative to the collection of refuse, garbage, brush or leaves or any regulation made pursuant to such ordinance.
(h) Whoever violates this section is guilty of a misdemeanor of the third degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
