The 2018 International Property Maintenance Code is hereby amended and changed in the following respects (Ord. C26-94. Passed 4-18-94; Ord. C69-14. Passed 12-1-14; Ord. C59-17. Passed 12-4-17.):
(a) PM-101.1 Title:
These regulations shall be known as the "Property Maintenance Code of Grove City", hereinafter referred to as "this code". (Ord. C4-97. Passed 1-21-97.)
(b) PM-101.4 is hereby amended to read as follows:
PM-101.4 Severability and validity:
Sections and subsections of this Property Maintenance Code and the several parts and provisions thereof are declared to be independent sections, subsections, parts and provisions, and the holding of any such section, subsection, part or provision thereof to be unconstitutional, void or ineffective for any cause shall not affect nor render invalid any other such section, subsection, part or provision thereof. (c) PM-102.3 is hereby enacted to read as follows:
Application of other codes. Repairs, additions or alterations to a structure, or changes of occupancy, shall be done in accordance with the procedures and provisions of the Ohio Building Code; Ohio Energy Conservation Code, Ohio Fire Code, International Fuel Gas Code, Ohio Mechanical Code, Ohio Residential Code, Ohio Plumbing Code and NFPA 70. Nothing in the code shall be construed to cancel, modify or set aside any provision of the Grove City Code.
(d) PM-103.5 Fees:
The fees for activities and services performed by the department in carrying out is responsibilities under this code shall consist of a fifty dollars ($50) administration fee and the cost of any contracted services.
(e) PM-104.3 is hereby amended to delete the last sentence and add the following:
PM-104.3 Right of entry and inspection: (Delete last sentence and add)
If requested entry is refused or is otherwise unobtainable, a search warrant shall be obtained before such entry or inspection is made, except in the case of an existing emergency in which case entry may be made at any time and no search warrant is necessary. No person shall refuse to permit such emergency entry or inspection, nor shall any person hinder, obstruct, resist or abuse any person making or attempting to make such entry or inspection.

(f) PM-106.4 is hereby amended to read as follows:
PM-106.4 Penalty:
The owners, agents or other persons in charge or control of any building, structure or premises where anything in violation of this Code is placed or exists, and any person who violates or causes or knowingly permits any violation of this code in buildings, structures or on premises under his charge or control, and any person who violates any provision of this code or fails to comply therewith shall, for each violation or noncompliance, be deemed guilty of a misdemeanor of the second degree unless otherwise specifically indicated, and punished as set forth in Section 501.99 of the General Offenses Code of the Codified Ordinances. Each day of such violation or failure to comply shall constitute a separate offense. (See Section 501.99 of the Codified Ordinances applicable to misdemeanor classifications.) (Ord. C69-14. (g) PM-106.5 is hereby enacted to read as follows:
PM-106.5 Penalty does not preclude other remedial action:
The imposition of any penalty shall not preclude the Director of Law from instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful repair or maintenance; to restrain, correct or abate a violation; to prevent the occupancy of a building, structure or premises; or to require compliance with the provisions of this Property Maintenance Code or other applicable laws, ordinances, rules or regulations, or orders or determinations of the code official or Director of Safety. (h) PM-111.1 through 111.8 is hereby deleted and new Section 111.1 is hereby enacted to read as follows:
PM-111.1 Right to Appeal:
Appeals from a decision of the code official or a notice or order issued under this code shall be governed by Section 501.13 of the Codified Ordinances of the City of Grove City and, except in cases of emergency as set forth in Sections PM-109.1 through PM-109.6, filing of an appeal from such decision, notice or order shall suspend action on enforcement until the appeal is acted upon by the Director of Safety.
