1048.02 CHARGES.
   (a)   Availability of Service. The existing electrical distribution system is available for full domestic electric service, commercial service and industrial service.
    (b)   Energy Charges. The following charges for electricity are hereby established:
      (1)   First 40 Kwhrs used in one month            $0.21 per kWh
      (2)   Next 160 Kwhrs used in one month          0.16 per kWh
      (3)   All over 200 Kwhrs used in one month          0.114 per kWh
   (c)   Demand Charge. For customers having connected power loads of five H.P. or more, a demand charge, in addition to the energy charge set forth in division (b) hereof, will be made as follows:
      (1)   For the first three kw of demand per month      No charge
      (2)   For all over three kw of demand per month      $2.60
    (d)   Minimum Charge. Consumers are subject to a minimum monthly charge as follows:
      (1)   Single-phase residential, small
         commercial and small industrial
         customers                      $8.40
      (2)   Combined single-phase and/or three-
         phase customers having a connected
         motor load of less than five H.P.             8.40
      (3)   Single-phase residential and small
         commercial three-wire service outside
         the Village                       8.40
      (4)   Single-phase and/or three-phase
         customers having connected motor
         loads of five H.P. and greater,
         as follows:
         A.   For the five H.P. of connected
            loads                      $8.40/month

   (e)   Discount. A discount of 10% will be allowed to qualified church organizations if the bill is paid by the twentieth day of the month in which it is sent out. (Ord. 916. Passed 7-6-99.)
   (f)   Measurement of Energy and Determination of Demand. Energy supplied hereunder will be delivered through not more than one single-phase and/or one polyphase meter. A customer’s monthly billing demand may be the highest registration of a 15-minute integrating demand meter or indicator installed continuously or periodically, or the highest registration of a thermal-type demand meter installed continuously or periodically, or may be estimated by the Administrator.
    (g)   Penalty Charge. A penalty charge of 10% will be added to all bills not paid in full on or before the fifteenth day of the month in which they are sent out.

   (h)   Primary Service. Customers using the primary voltage of 2,400 volts shall be given a 10% discount on the energy portion of the charge. Customers shall furnish all transformers and protective equipment. The minimum monthly billing demand shall be 50 KW. The resulting minimum monthly bill shall be 50 times the local price per kilowatt.
    (i)   Responsibility for Charges. Pursuant to Ohio R.C. 735.29, each owner of record of real property is ultimately responsible for all sums charged by competent authority for the use of electric power upon such property.
   (j)   Special Terms and Conditions. Electric welders, X-ray machines and other electrical equipment having similar electrical operating characteristics shall not be connected to Village power without permission from the Administrator. If the Village, in order to prevent voltage fluctuation or disturbances on its system, installs separate transformers to serve such a load, a minimum monthly charge for such service will be one dollar and ninety cents ($1.90) per kilo-voltamphere of installed transformer capacity instead of the minimum charge set forth under division (d) of this section.

   (k)   Temporary Service for Contractors. Contractors shall receive bills monthly for usage of electricity through temporary meters.

    (l)   Excise (Kilowatt-Hour) Tax Adjustment. For all customers, the rates and charges set forth in the Village's electric rate schedules shall be increased by an amount equal to the excise (kilowatt-hour) tax imposed on the Village’s electric distribution system under Ohio R.C. 5727.81. Said increase shall become effective with the bills rendered on or after July 1, 2012 and shall thereafter be automatically adjusted to reflect any change in the kilowatt-hour tax imposed by Ohio R.C. 5727.81.

   (m)   Service Charge for Returned Dishonored Checks. There shall be a service charge of ten dollars ($10.00) above the bank charge incurred by the Village for the return of dishonored checks deposited to the Village account. This charge is to be added to the amount of the check and collected at the time of the redemption of the check.

   (n)   Kilowatt-Hour (KWh) Tax. The KWh tax will be assessed to electrical customers being supplied through the Village electric distribution system as follows:
      (1)   For the first 2,000 KWh used, the tax rate is $0.00465 per KWh.
      (2)   For the next 2,001 to 15,000 KWh used, the tax rate is $0.00419 per KWh.
      (3)   For anything above 15,000 KWh used, the tax rate is $0.00363 per KWh.
   (o)   Kilowatt-hour tax payment to General Fund. The Kilowatt-hour tax payments made to the General Fund shall remain in the General Fund account.

   (p)   Security Lighting.
      (1)   Availability of service.
         A.   Available to any consumer where Village's standard outdoor lighting unit can be installed on the Village's existing pole without requiring any extension or addition to the Village's existing secondary or primary distribution facilities.
         B.   Where additional facilities are required, the consumer shall pay for the total installation cost for such additional distribution facilities (poles, wire and appurtenances and labor cost) as are required. In all cases the lighting fixture itself, including will be installed, owned, operated and maintained by the Village.
         C.   This service is available where there is reasonable assurance that the service to be furnished will be permanent, and the Village reserves the right to refuse to furnish the lighting service covered by this section where, in the Village's opinion, the installation will be of permanent character.
      (2)   Application for service. All applications shall have the following option.
         A.   Option #1: Pay initial cost up front. Where the premises are occupied by a tenant, the Village reserves the right to require the application for service to be made by the property owner with bills to be sent to the attention of the tenant. However, the property owner shall be responsible for the payment of all bills.
      (3)   Net rate. The net rate per overhead metal Halide or equivalent lighting unit shall be:

         The monthly fee includes all electric usage, needed maintenance and replacement if necessary.
      (4)   Advance payment of annual charge. When determined by the Village that consumer's service is seasonal or non-permanent in character, the Village reserves the right to require twelve months advance payment before service is established and thereafter to require similar twelve months of service.

   (q)   Power Supply Cost Adjustment. The Village’s electric rates and charges are based upon a base power supply cost of $0.0883 per kWh. In the event that said average power supply costs per kWh is above or below $0.0883 per kWh, the Villages electric rate schedules will be adjusted as specified below:
      (1)   Each month, the Village’s running three month average power supply cost per kWh shall be determined by dividing the sum of the most recent three months' total power supply costs from all suppliers, including costs associated with ownership and operation of generating facilities owned in whole, or in part, by the Village, developmental costs associated with power supply resources, transmission related charges and ancillary service fees, by the total energy delivered to the Village during the same three month period.
      (2)   If said three month average power supply cost per kWh is above or below the base power supply cost of $0.0883 per kWh, the rates per KWh set forth in the Village’s electric rate schedules shall be increased or decreased in the manner specified in paragraph (3) and (4) below.
      (3)   Any increase or decrease per kWh above or below the base power supply cost of $0.0883 per kWh shall be determined to four decimal places and any resultant differential shall be multiplied by 1.10 to compensate for the Village’s distribution system energy losses.
      (4)   The resultant power supply cost adjustment determined pursuant to paragraph (3) above shall be applied to the kWh billed for all electric customers.
