(a) A person owning or having charge of land within the Village shall keep such land free and clear of all noxious weeds and rank vegetation and shall cut all such weeds and vegetation on the lots owned or controlled by him or her whenever such vegetation attains a height of six inches.

(b) Whoever violates or fails to comply with this section is guilty of a minor misdemeanor for a first offense. Whoever violates or fails to comply with this section after having been previously convicted of such offense is guilty of a misdemeanor of the fourth degree. The penalty shall be as provided in Section 698.02.
