§ 114.20 FAILURE OF TOWN TO MEET DEADLINE NOT TO RISK APPLICANT/ RESOLUTION LICENSEE RIGHTS.
   In the event that a town official is required to take an act or do a thing pursuant to this chapter within a prescribed time, and fails to take such act or do such thing within the time prescribed, said failure shall not prevent the exercise of constitutional rights of an applicant or licensee. If the act required of the Town Council under this chapter, and not completed in the time prescribed, includes approval of conditions necessary for approval by the Town Council of an applicant or resolution licensee’s application for sexually oriented business resolution license or a sexually oriented business employee’s resolution license (including a renewal), the condition shall be deemed met the day after the deadline for the Town Council action has passed.
