If an animal, other than an animal that causes excessive noise, as provided in § 90.99(B)(2), or that damages property, as provided in § 90.99(B)(3) is found in violation of this chapter, an official warning shall be given by the Department of Animal Control to the owner of the offending animal. If a second verified complaint is made after official warning has been given of a violation of this section, the Department of Animal Control may impound the animal and issue a fine as set out in § 90.99.
