§ 153.0047 UTILITIES.
   (A)   A conservation subdivision shall comply with the utilities standards (§§ 153.1090 through 153.1095 of this chapter), except as provided in subsection (B) below.
   (B)   Land within the rights-of-way for underground pipelines may be included as part of the required conservation areas. Land within the rights-of-way of high-tension power lines shall not be included as part of the minimum required conservation area.
   (C)   Where permitted by the County Health Department, a conservation subdivision may use a shared septic drainfield system, as defined in state regulations, to dispose of on-site wastewater. The drainfield or absorption area for the shared septic system may be located in a conservation area if the location is permitted by the County Health Department and complies with the following to the extent permitted by state law and the applicable city regulations:
      (1)   The absorption field is an underground drainage field or an absorption field for spray irrigation purposes for a land treatment disposal system; or
      (2)   The absorption field is a mound system compliant with state regulations that is limited to not more than 10% of the required minimum open space.
