§ 54.12 GROUND WATER AS POTABLE WATER PROHIBITED.
   (A)   Use of groundwater as a potable water supply is prohibited within a limited area within the city. The area which prohibits the use of groundwater as a potable water supply is comprised of the following parcels: 05-10-15-206-014, 05-10-15-206-016, 05-10-15-206-017, 05-10-15-206-018 and 05-10-15-207-018, and the rights-of-way of Franklin Avenue and Third Street adjacent to these parcels. The drawing attached to Ord. 3092: Drawing 0001A, illustrates the location of the area affected by this section. Except for such uses or methods in existence before the effective date of this section, the use or attempt to use as a potable water supply groundwater from within the limited area within the city, as a potable water supply, by the installation or drilling of wells or by any other method is hereby prohibited. This prohibition expressly includes the area described herein and in Drawing 0001A. This prohibition expressly includes the city.
   (B)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      PERSONS. Any individual, partnership, co-partnership, firm, company, limited liability company, corporation, association, joint stock company, trust, estate, political subdivision, or any other legal entity, or their legal representatives, agents or assigns.
      POTABLE WATER. Any water used for human or domestic consumption, including, but not limited to, water used for drinking, bathing, swimming, washing dishes or preparing foods.
