§ 153.1443 TERMINATION OF NON-CONFORMING STRUCTURES.
   (A)   Damage to structures. The right to operate and maintain any non-conforming structure shall terminate and shall cease to exist whenever the non-conforming structure is damaged in any manner and from any cause whatsoever, and the cost of repairing such damage exceeds 50% of the replacement cost of such structure on the date of such damage.
   (B)   Obsolescence of structure. The right to operate and maintain any non-conforming the non- conforming structure becomes obsolete or substandard under any applicable ordinance of the city, and the cost of placing such structure in lawful compliance with the applicable ordinance exceeds 50% of the replacement cost of such structure on the date that the proper official of the city determines that such structure is obsolete or substandard.
   (C)   Determination of replacement cost. In determining the replacement cost of any non-conforming structure, the cost of land or any factors other than the non-conforming structure itself shall not be included.
