§ 153.1375 SOLID WASTE FACILITIES.
   (A)   Applicability. This section applies to any of the following, which are referred to collectively as “solid waste facilities”:
      (1)   Any “sanitary landfill”, which means a facility for disposal of solid waste on land in a sanitary manner in accordance with the rules concerning sanitary landfills adopted under this chapter;
      (2)   Any “solid waste convenience center”, which means a facility that accepts only bagged residential waste and specified recyclable goods. Solid waste convenience centers are permitted in the zones indicated only if:
         (a)   The waste does not include waste generated by construction and demolition activities, yard waste, liquid waste or hazardous waste;
         (b)   The facility is enclosed by a buffer (as defined by §§ 153.1105 through 153.1110 of this chapter) that completely screens from view the operational activity; and
         (c)   The facility is aesthetically landscaped to further assure that the facility becomes a more-than-acceptable neighbor for the area in which the facility is designed, constructed and operated.
      (3)   “Solid waste transfer station”, which means a place or facility where waste materials are taken from smaller collection vehicles (e.g., compactor trucks) and placed in larger transportation vehicles (e.g., over-the-road tractors utilizing trailers that are top-loaded) for movement to designated disposal areas (usually landfills). The stations are usually served by a fleet of over-the-road semitractors and transfer trailers, as well as specialized on-site loading and trailer staging equipment. Solid waste transfer stations may accept only residential; commercial; institutional; and industrial, non-hazardous, solid municipal waste. Solid waste transfer stations are permitted only if the waste taken to the transfer station is stored and transferred entirely within covered buildings.
   (B)   Standards for sanitary landfills.
      (1)   No CUP or, if no CUP is required, zoning clearance development approval, shall be issued for a solid waste facility until all applicable development approvals have been issued by the state’s Environmental Protection Agency.
      (2)   A Type D buffer, as provided in §§ 153.1120 through 153.1130 of this chapter, shall be established along street frontages and property boundaries that border residential zoning districts and residential uses. Trees shall be of such height when planted that they shall reach a height of ten feet in two years.
      (3)   Only one ground sign per entrance to the storage yard is permitted. Such sign shall not exceed nine square feet in area. If lighted, such sign may include indirect lighting or non-flashing illumination. Such sign shall be located on the same lot or parcel as the solid waste facility.
      (4)   New solid waste disposal facilities are prohibited in the 100-year floodplain.
      (5)   Ingress to and egress from solid waste facilities shall be permitted by roads to serve only the solid waste facilities. Such roads shall be designed and constructed consistent with §§ 153.1065 through 153.1078 of this chapter; except that, sidewalks and street trees are not required. Street design shall allow a weight limit of 19,000 pounds per axle and shall intersect directly with a federal or state maintained road. Approach and departure traffic routes for a solid waste facility shall not be permitted through local streets or any other system of streets primarily intended to provide access to residences in a neighborhood.
      (6)   A non-climbable security fence at least seven feet in height shall be installed around all portions of solid waste facilities directly involved in the storage, handling and disposal of solid waste.
      (7)   All buildings or structures used for the storage, treatment, processing, recycling, collection, recovery or disposal of solid waste shall be located at least 500 feet from any exterior property line when such property line abuts a residential zoning district.
      (8)   The hours of operation shall be limited from 7:00 a.m. to 7:00 p.m.; except that, the hours of operation may be extended when the Planning Department certifies that sanitation conditions require an extension of operating hours.
      (9)   Municipal solid waste landfills shall be covered in accordance with the state’s environmental regulations.
      (10)   Exterior lighting shall not cause illumination in excess of one foot candle at any property line, except that internally illuminated signs at the entrance to the landfill may exceed this standard where necessary.
   (C)   Submittal requirements. An application for development approval shall include the information submitted to the Department of Environment and Natural Resources for the permitting of a solid waste management facility.
