§ 153.1365 HOUSING FACILITIES FOR OLDER PERSONS.
   (A)   Applicability. HOUSING FACILITY FOR OLDER PERSONS (HFOP) means any apartment that complies with the provisions of 24 C.F.R. §§ 100.304 through 100.307.
   (B)   Uses. An HFOP is permitted as of right in any “NS” (Neighborhood Suburban) or “NU” (Neighborhood Urban) Zoning District subject to the requirements of this section.
   (C)   Federal restrictions. Prior to issuance of an application for development approval authorizing construction or establishment of an HFOP, the applicant shall provide to the Code Enforcement Officer:
      (1)   A copy of the policies and procedures required by 24 C.F.R. § 100.306; and
      (2)   A copy of the verification of occupancy required by 24 C.F.R. § 100.307.
   (D)   “NS” (Neighborhood Suburban) Districts. An HFOP permitted within “NS” (Neighborhood Suburban) Zoning Districts shall comply with the following:
      (1)   The building shall not exceed two stories in height;
      (2)   The building shall conform to the setback standards generally applicable within the zoning district;
      (3)   The building shall comply with the minimum and maximum parking standards applicable to multi-family dwellings; and
      (4)   The proposed development shall comply with all applicable standards of Division 11 of this chapter.
