§ 153.0961 PERIODIC REVIEW, TERMINATION OR MODIFICATION.
   An adopted development agreement shall be reviewed at least every 24 months, at which time the owner or owners of the property subject to the development agreement shall be required to demonstrate good faith compliance with the terms of the development agreement. If, as a result of such review, the city finds and determines, on the basis of substantial evidence, that the owner or owners have not complied in good faith with the conditions of the development agreement, the city may unilaterally terminate or modify the agreement. Such action shall be taken by the city at a regular or special meeting, provided that the developer is notified at least ten days in advance of such meeting.
