(A) Reviewing agency. The reviewing agency for preliminary plats is the Planning Commission. All preliminary plats shall be processed through a quasi-judicial procedure. Upon final approval, a preliminary plat shall be made a matter of record as follows:
(1) The reasons for approval, disapproval or approval with conditions shall be maintained on file with the Code Enforcement Officer; and
(2) The approved plat shall be indexed and filed by the Code Enforcement Officer.
(B) Time limit for approval. The reviewing agency shall act on a plat within 30 days after the date the plat is filed. Plats shall not be deemed filed unless and until it is determined that complete information has been provided, as set forth in subsection (C) below. A plat shall be approved or disapproved within the 30-day period. Should there be no approval or disapproval within 30 days the applicant shall notify the City Clerk/Finance Director. The City Clerk/Finance Director shall notify the responsible party or agency. The responsible party or agency shall then respond to the request within 30 days. A plat is deemed approved unless the responsible party or agency responds to the City Clerk/Finance Director’s request within 30 days.
(C) Withdrawal of application. Once filed with the reviewing agency, a plat may be withdrawn, provided that a written notice of withdrawal stating the reasons for the request is submitted to the Code Enforcement Officer. The 30-day time limitation shall cease on the date that the notice is received by the Code Enforcement Officer; however, the Code Enforcement Officer may elect to present a withdrawal request to the Planning Commission for consideration.
