The Greenville County Construction Board of Adjustments and Appeals (Board) as established by the County of Greenville shall hear and decide requests for variances from the requirements of this ordinance. The application for a variance shall be filed on a form obtained from the local administrator.
(a) Limitations on authority. An application for appeal shall be based on a claim that the true intent of this article or the rules legally adopted there under have been incorrectly interpreted; the provisions of this article do not fully apply; or, an equally good or better form of construction is proposed.
(b) Functionally dependent uses. Variances may also be issued for development necessary for the conduct of a functionally dependant use, provided the criteria of this section are met, no reasonable alternative exists, and the development is protected by methods that minimize flood damage and create no additional threat to public safety.
